Dozens of businesses in the Bay Area have been hit with ADA lawsuits - all of them filed by the same individual. Orlando Garcia has sued around 60 businesses in the area and has filed over 700 lawsuits since 2014. Now a handful of Alameda County businesses are fighting back stating that these types of lawsuits are not what the ADA or the California Unruh Act were intended for.
One of the businesses involved, The Sandwich Board, is prepared to stand their ground given that they have other wheelchair users who visit on a regular basis and have never had a problem accommodating them in the store. Owner Michael 'Lee wants the lawsuit dismissed and for Garcia to be declared a vexatious litigant, which is a serial filer abusing the court system.
